Chern was singled out to pay $50,000 of the total fine because he introduced the towing scheme at UpRight. "The court found Chern's overall emphasis on sales and profit to be far more credible than his goals of helping consumers execute on decisions they had already made in their own minds," Black wrote.
Black also noted concerns about Scanlan's role at UpRight, writing that "while Scanlan is not one of the technical, legal owners of (UpRight), his hand is never far from the wheel." He received a salary of $200,000, reported to the IRS on a Form 1099, which is used by independent contractors. Also, UpRight Law uses staffing and marketing companies ultimately controlled by Scanlan.
Black closed his opinion saying local lawyers would be held responsible for any infractions committed at the headquarters of a national bankruptcy law firm like UpRight. Two of the 400 lawyers UpRight has working in jurisdictions around the country were disciplined in this case.
"Attorneys considering joining firms with this business model should understand that, in this court, while an injury might be initiated elsewhere—there is a real possibility that the pain is going to be felt at home," he wrote.
